Terms of Use

1. Who we are and how to contact us

NAKIL (“NAKIL”, “we”, “us”) operates the property platform available at www.nakil.co (the “Platform”), from Beirut, Lebanon. The Platform lists residential and commercial property in Lebanon. For any question about these terms, write to support@nakil.co.

2. Accepting these terms

By browsing the Platform, creating an account, publishing a listing or sending an enquiry, you accept these Terms of Use and agree to be bound by them. If you do not accept them, please stop using the Platform. If you use the Platform on behalf of a company (for example, a real-estate agency), you confirm you are authorised to bind that company, and “you” includes it.

3. What NAKIL is — and is not

NAKIL is a discovery and lead-generation platform. We connect people searching for property with the agents, agencies and owners who advertise it. NAKIL is not a real-estate broker, agent or party to any transaction. We do not own, sell, rent, manage, inspect or value the properties listed; we do not process property payments, deposits, commissions or contracts; and nothing on the Platform is legal, financial or investment advice. Any viewing, negotiation, agreement or payment happens directly between you and the advertiser, at your own risk and responsibility.

4. Listings and their accuracy

Listings are created by third parties — agencies, agents and private owners. Every advertiser is responsible for holding the licences and authorisations required by the law that applies to them, for having the owner’s permission to advertise, and for keeping each listing truthful, current and lawful — one real property per listing. We moderate listings for quality before they go live and may edit, decline or remove any listing at our discretion, but we do not verify ownership, condition, availability, price or legal status, and we give no warranty as to the accuracy of any listing. Always carry out your own checks — inspect the property, verify ownership documents and the advertiser’s identity, and take professional advice — before paying anything or signing anything.

5. Prices, currency conversion and indicative tools

Every price is stored in the currency the advertiser set. Converted prices (for example between USD and LBP) are calculated at a platform rate kept in line with the live market, are clearly marked approximate, and exist for convenience only — the advertised amount in the original currency is the asking price. Calculators, value guides and market statistics are indicative estimates and must not be relied on as valuations or advice.

6. Your account

You must give accurate information when registering and keep it up to date. You are responsible for your password and for everything done through your account; tell us at once if you suspect it has been compromised. You must be at least 18 to hold an account. We may suspend or close accounts that breach these terms, provide false information or put other users at risk. You can ask us to delete your account by writing to support@nakil.co.

7. Acceptable use

You agree not to: post false, misleading or unlawful content; advertise a property you have no right to advertise; harvest or scrape data from the Platform; interfere with its security or operation, or attempt unauthorised access; impersonate any person; send spam or unsolicited marketing to users you contact through the Platform; upload malicious code; or use the Platform for money laundering or any other illegal purpose. Enquiries and contact details you receive as an advertiser may be used only to respond to that enquiry.

8. Paid services

Agency plans and promoted-listing features are paid services, currently activated by the NAKIL team after payment by bank transfer or money-transfer services. Fees are stated when you order and, except where the law requires otherwise, are non-refundable once the service has started. A paid plan buys visibility tools — it does not guarantee approval of any listing, a number of leads, or a sale or letting.

9. Content you upload

You keep ownership of the photos, text and other material you upload, and you confirm you have the right to publish it. You grant NAKIL a worldwide, royalty-free, transferable licence to host, display, reproduce and adapt that material for operating, promoting and improving the Platform (including showing listings in search results, maps, alerts and marketing). We may remove content that breaches these terms or the law.

10. Intellectual property

The Platform, its design, software, databases and the NAKIL name and logo belong to us or our licensors. You may use the Platform for your personal or internal business purposes; you may not copy, resell, republish or build a competing dataset from it without our written permission.

11. Availability and changes

We work to keep the Platform available and accurate, but it is provided “as is” and we do not guarantee uninterrupted or error-free operation. We may change, suspend or withdraw features at any time. We may amend these terms; the date above shows the latest revision, and continued use after a change means you accept it. For significant changes we will make reasonable efforts to notify registered users.

12. Liability

Nothing in these terms excludes liability that cannot be excluded by law. Subject to that: NAKIL is not liable for the conduct of advertisers or seekers, the accuracy of listings, or any transaction, dispute, loss or damage arising between users; and we are not liable for indirect losses, lost profits, or loss of data or opportunity. For any claim connected to the Platform, our total liability is limited to the amount you paid us for the service concerned in the twelve months before the claim or, if you paid nothing, USD 100.

13. Indemnity

If you advertise on the Platform, you will compensate NAKIL for losses, claims and costs we incur because a listing or other content you published was unlawful, misleading or infringed someone else’s rights.

14. Reporting a problem

To report a listing you believe is fraudulent, misleading or infringing, use the report tools on the Platform or write to support@nakil.co. We review reports and make reasonable efforts to remove unlawful content promptly.

15. Governing law and jurisdiction

These terms are governed by the laws of the Lebanese Republic, and the courts of Beirut have exclusive jurisdiction over any dispute arising from them or from your use of the Platform — without prejudice to mandatory consumer protections or real-estate regulations that apply where a property is located.

16. General

If part of these terms is found unenforceable, the rest stays in force. A failure to enforce a right is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganisation or sale of the business. These terms, together with the Privacy Policy, are the entire agreement between you and NAKIL about the Platform.
